On March 1 2022, the Department of Commerce (Commerce) announced its affirmative preliminary determinations in the countervailing duty (CVD) investigations of certain freight rail coupler systems and components thereof from China.

Imports of freight rail coupler systems and certain components thereof enter under an HTSUS subheading that covers subject and non-subject merchandise. In addition, unfinished merchandise or merchandise that is imported attached to finished rail cars may enter under other HTSUS subheadings. Therefore, publicly available import data may not accurately reflect actual imports of the freight rail coupler systems and certain components covered by the proposed scope of the investigations. The petitioner estimated the 2019 import quantity of freight rail coupler systems and certain components thereof at 888,888 units. U.S. Census Bureau, accessed through Global Trade Atlas (converted from metric tons to short tons) (Harmonized Tariff Schedule of the United States subheading 3102.80.0000).

The petitioner is the Coalition of Freight Coupler Producers, the members of which are McConway and Torley, LLC (M&T) (Pittsburgh, PA) and the United Steel, Paper and Forestry, Rubber, Manufacturing, Energy, Allied Industrial and Service Workers International Union, AFL-CIO, CLC (the USW) (Washington, DC).
