OPA - U.S. Department of Commerce Announces Final Determinations in the Antidumping and Countervailing Duty Investigations of Solar Panels From Multiple Countries

WASHINGTON, D.C. - Today, the U.S. Department of Commerce (Commerce) announced its final affirmative determinations in the antidumping duty (AD) and countervailing duty (CVD) investigations of crystalline photovoltaic cells (solar panel cells) from Cambodia, Malaysia, Thailand, and the Socialist Republic of Vietnam (Vietnam).

Based on facts submitted through transparent investigative proceedings, Commerce determined that imports of solar cells from Cambodia, Malaysia, Thailand, and Vietnam are being dumped into the U.S. market and receiving countervailable subsidies at the average rates outlined in the chart below.

In the CVD investigations involving Cambodia, Malaysia, Thailand, and Vietnam, Commerce found that companies in each country were receiving subsidies from the Government of China. These are among the first CVD investigations wherein Commerce has made an affirmative finding that companies received transnational subsidies.

“The Commerce Department is holding China accountable for its transnational subsidies through other countries that harm American industry. Market-distorting, unfair trade practices against America have no place to hide,” said Secretary of Commerce Howard Lutnick. “The Commerce Department continues to enforce our trade laws fully so that we can rebuild U.S. manufacturing and restore American competitiveness. We must ensure a level playing field for American businesses and workers.” 

The International Trade Commission (ITC), a separate agency, now has until June 2, 2025 to make its final injury determination. If the ITC makes affirmative country-specific final injury determination, Commerce will institute AD and CVD orders at the rates above. If the ITC makes a negative determination, no orders will be issued.
