Terms of Participation

In order to make the most of your experience and ensure that the U.S. Commercial Service (CS) meets your expectations, please accept the terms of participation included with this document. We will protect business confidential information to the extent provided under Federal law. As a valued client, your satisfaction is of the utmost importance to us and we want to make sure we are meeting your expectations and addressing any of your concerns. Information Collection

This information collection is authorized by law (15 U.S.C. 1501 et. seq. 15 U.S.C. 171 et seq.) Although you are not required to respond, no agreement may be concluded for Company’s/Participant’s participation in a U.S. Department of Commerce-scheduled promotional event/service unless a completed Participation Agreement form has been received. Public reported burden for this collection of information is estimated to be 20 minutes per response, including the time for reviewing instructions, and completing and reviewing the collection of information. Notwithstanding any other provision of law, no person is required to respond, nor shall a person be subject to a penalty for failure to comply with a collection of information subject to the requirements of the Paperwork Reduction Act unless that collection of information displays a current valid OMB Control Number. Send comments regarding the burden estimate or any other aspect of this collection of information, including suggestions for reducing this burden to the Reports Clearance Officer, International Trade Administration, Department of Commerce, Room 4001, 14th St. and Constitution Avenue, N.W., Washington, DC 20230.

Cancellation

Either the Department of Commerce or the Company/Participant may cancel this agreement by providing written notice to the other party. Cancellation shall be effective upon receipt of such notice. Upon cancellation, the Company/participant will remain liable to the Department of Commerce for any cost incurred prior to cancellation and any reasonable charges resulting from the cancellation (e.g., costs for terminating related contracts for services). If the Company/participant prepaid for the services, the Department of Commerce will refund any excess amounts.

Notice of Photographing, Filming, Recording, or Otherwise Capturing Likeness and Profile of Participant

The U.S. Department of Commerce (“Commerce”) hereby notices that names, images, likenesses, portraits, or voices (“Likenesses”) may be photographed, filmed, recorded, or otherwise captured during the [name of: event/activity]. By participating, you grant to Commerce the irrevocable, lifetime, royalty free, non-exclusive, worldwide right to use your Likeness in all forms, in all manners, and in all media now existing or to be created in the future, and without compensation, as part of these activities.

By participating, you also grant to Commerce the irrevocable right to use biographical information provided to us about you and your organization (“Profile”) in all forms, in all manners, and in all media now existing or to be created in the future, as part of the above-referenced activities. You also waive any right to inspect or approve your Likeness or Profile in the finished, including written, copy that may be created and appear in connection therewith. No claim may be made based on any usage of any video, photographs, or works derived there from, including but not limited to claims for invasion of privacy or publicity or for libel. Should Commerce use said Likeness or Profile, you absolve Commerce from any liability resulting from any use thereof.

By participating, you further warrant that you are of full age of majority, that you have every right to consent, that you have read this Notice and that you are fully familiar with and understand the contents thereof. You agree that this Notice shall be binding on you, your legal representatives, heirs, and assigns.

The purpose of collecting this information is in support of the offering of products and services by the International Trade Administration Global Markets business unit. The information collected includes information associated with tracking client participation for events and services, collection of any fees (through pay.gov), and the monitoring of any associated financial transactions. Personally identifiable information such as name, email address, address, telephone numbers, and financial transaction information may be collected.

Disclosure of this information is permitted under the Privacy Act of 1974 (5 U.S.C. Section 552a) to be shared among International Trade Administration staff for work-related purposes.  

Disclosure of this information is also subject to all of the published routine uses as identified in the Privacy Act System of Records Notice ITA-7, Export.gov; COMMERCE/DEPT-23, Information Collected Electronically in Connection with Department of Commerce Activities, Events, and Programs; COMMERCE/DEPT-2 Accounts Receivable; and COMMERCE/DEPT-18, Employees Personnel Files Not Covered by Notices of Other Agencies.  

Providing this information is voluntary. Failure to provide this information may affect the International Trade Administration’s ability to provide products and services that are being offered.
